That is an old (and rather unnecessary) residual check to force people 
to use proper queues, I believe. Check the comments for the ticket, that 
if statement (in ieee80211_wme_updateparams_locked()) is your solution. 
Also, other  solution (a more elegant one, without changing the driver 
code) is to use hping3 and mark your TOS field accordingly to direct 
your packets to the queues you can modify (BK, VI, VO).
